At Carson Madison, our mediators help divorcing spouses complete the entire mediation process remotely. Mediation can be completed virtually from the comfort of their own homes. The virtual mediation process is quite simple. Once the parties decide to mediate, we send them a link to schedule their mediation session at a convenient day and time. We even offer some Saturday mediation sessions. Typically, we can book the mediation session within a few weeks.
Once the mediation session is scheduled, we send the parties the documents they need to complete regarding their assets, liabilities, and other financial information. When the mediation date arrives, both parties login remotely via a zoom link that was sent to them. The parties can be together or at separate locations. They do not have to have an attorney present, but they have the option to be represented by an attorney.
In a divorce, there are three main documents we complete during the mediation process. The first one is the Georgia child support worksheet. We help the parties use the Georgia child support calculator to calculate how much child support will be required of the non-custodial parent. The second document is a settlement agreement where the parties decide on how to divide their assets and liabilities. The last document is the parenting plan. This document details visitation schedules and who has decision making authority on issues such as education, medical, and extracurricular activities. In Georgia, all three documents are required to be filed with the divorce paperwork.
There are so many benefits to mediating a divorce. Mediation speeds up the divorce process. In Georgia, a divorcing couple must wait 30 days after filing for divorce to complete the divorce process. After those 30 days, if all their documents are signed, they can submit them to the court to get a final divorce decree. Couples who do not go to mediation, may have to wait 12 to 18 months to get a court date for the judge to hear their case. Mediation is a quick, confidential, and private way to come to an agreement on the terms of a divorce. The mediator works with the parties to help them come to an agreement on property settlement, child support, custody, and alimony payments.
I would also like to mention the cost to mediate a divorce is a fraction of the cost of going to court. Typically, a contested divorce will cost over $25,000. Our mediation services are $125/hour per party. We can often complete the mediation process within a day. The only other fees would be the filing fees and the attorney fees. Going to mediation could save thousands of dollars in legal fees.
